1. Introduction

This Food Safety & Quality Policy (“Policy”) sets out Spinacho's commitment to promoting food safety, quality, and regulatory compliance across the Spinacho Platform. Spinacho is a brand owned and operated by Nutriwave Spinacho Foods Private Limited and operates as an FSSAI Licensed e-Commerce Food Business Operator.

Through the Platform, Customers can discover and order food from independent Restaurant Partners. As an e-Commerce Food Business Operator, Spinacho is committed to working with Restaurant Partners to encourage compliance with applicable food safety standards and maintaining a trustworthy ordering experience for Customers.

This Policy should be read together with the Terms & Conditions of the Platform.

2. Scope

This Policy applies to:

  • Restaurant Partners listed on the Platform;
  • Food and beverages offered through the Platform;
  • Customers using the Platform; and
  • Operational practices adopted by Spinacho relating to food safety and quality.

3. Regulatory Compliance

Spinacho operates in accordance with the applicable provisions of the Food Safety and Standards Act, 2006 and the regulations, guidelines, and directions issued by the Food Safety and Standards Authority of India (FSSAI), as applicable to an e-Commerce Food Business Operator.

Restaurant Partners are responsible for complying with all legal and regulatory obligations applicable to their food business.

4. Restaurant Partner Eligibility

To list food products on the Platform, Restaurant Partners are expected to:

  • Hold a valid FSSAI Licence or Registration, as applicable;
  • Operate their food business in accordance with applicable food safety laws;
  • Provide accurate business information during onboarding; and
  • Maintain required licences and approvals throughout their association with Spinacho.

Spinacho reserves the right to request updated regulatory documents from Restaurant Partners and may suspend or remove listings where compliance cannot be reasonably verified.

5. Food Preparation & Hygiene

Restaurant Partners are solely responsible for:

  • Procuring safe and suitable ingredients;
  • Hygienic storage of food and ingredients;
  • Food preparation practices;
  • Personal hygiene of food handlers;
  • Prevention of contamination;
  • Compliance with applicable food safety requirements; and
  • Maintaining clean kitchen facilities and food preparation areas.

Spinacho does not prepare, cook, or modify food offered through the Platform.

6. Menu Information

Restaurant Partners are responsible for ensuring that information published on the Platform is accurate, complete, and up to date, including:

  • Product names;
  • Descriptions;
  • Ingredients;
  • Pricing;
  • Portion sizes;
  • Dietary classifications (such as vegetarian or non-vegetarian); and
  • Availability.

Spinacho may review or moderate information published on the Platform but does not independently verify every menu item.

7. Allergen & Dietary Information

Restaurant Partners are encouraged to provide accurate allergen and dietary information wherever reasonably possible. Customers with allergies, food intolerances, or specific dietary requirements are encouraged to:

  • Carefully review available menu information; and
  • Contact the Restaurant Partner where clarification is required before placing an Order.

Spinacho cannot guarantee that food prepared by Restaurant Partners is free from allergens or cross-contamination.

8. Packaging Standards

Restaurant Partners are responsible for packaging food appropriately to:

  • Maintain food quality;
  • Reduce the risk of contamination;
  • Protect food during transportation; and
  • Preserve product integrity until delivery.

Packaging materials should be suitable for food contact and comply with applicable legal requirements.

9. Quality Monitoring

To promote quality across the Platform, Spinacho may:

  • Verify Restaurant Partner documentation during onboarding;
  • Review customer feedback;
  • Monitor recurring quality concerns;
  • Seek clarification from Restaurant Partners regarding reported issues; and
  • Take appropriate action where repeated or serious quality concerns are identified.

These measures are intended to support quality assurance and do not transfer responsibility for food preparation from the Restaurant Partner to Spinacho.

10. Food Safety Incidents

Where Spinacho becomes aware of information suggesting that a food product offered through the Platform may present a food safety concern, Spinacho may take appropriate action, including:

  • Reviewing the reported issue;
  • Communicating with the relevant Restaurant Partner;
  • Temporarily suspending affected menu items;
  • Temporarily suspending or removing Restaurant Partners from the Platform where appropriate; and
  • Cooperating with competent regulatory authorities, where required by Applicable Law.

11. Product Recall

Where required under Applicable Law or by a competent authority, Spinacho may assist Restaurant Partners in facilitating product recalls by:

  • Identifying potentially affected Orders;
  • Assisting with customer notifications;
  • Removing affected products from the Platform; and
  • Cooperating with regulatory authorities.

Restaurant Partners remain responsible for fulfilling their legal obligations relating to food recalls.

12. Customer Responsibilities

Customers are encouraged to:

  • Review menu information before placing an Order;
  • Inform Restaurant Partners of known allergies where appropriate;
  • Consume food promptly after delivery;
  • Follow any storage or consumption instructions provided by the Restaurant Partner; and
  • Report genuine food safety concerns through the Platform's official support channels.

13. Continuous Improvement

Spinacho is committed to continuously improving its Platform, operational processes, and Restaurant Partner onboarding practices to promote higher standards of food safety, quality, and customer confidence.

14. Policy Updates

Spinacho reserves the right to amend this Policy from time to time. Updated versions will be published on the Platform together with the revised “Last Updated” date. Continued use of the Platform after publication constitutes acceptance of the updated Policy.
